ED SHEERAN is facing a trial in a copyright infringement case involving MARVIN GAYE's 1973 hit, "Let's Get It On," a U.S. judge ruled THURSDAY, according to REUTERS.
U.S. District Judge LOUIS STANTON denied SHEERAN's bid to dismiss the suit by STRUCTURED ASSET SALES, LLC, which controls a portion of the copyright of the song from co-writer ED TOWNSEND's estate.
STANTON ruled a jury must decide the case because experts on both sides disagree on whether SHEERAN's song does indeed infringe on the GAYE tune.
“Although the two musical compositions are not identical, a jury could find that the overlap between the songs' combination of chord progression and harmonic rhythm is very close,” STANTON stated in his ruling.
HILLEL PARNESS, an attorney for STRUCTURED ASSET SALES, said the company is "pleased" with the decision. STANTON ruled that jurors must decide whether SAS can include concert revenue in damages, rejecting SHEERAN’s argument that ticket sales weren’t tied to the alleged infringement.
A similar suit against the singer-songwriter by SAS is currently stayed, and a separate suit by another portion of TOWNSEND’s estate is awaiting trial.
“Thinking Out Loud” peaked at #2 on the BILLBOARD Hot 100 in FEBRUARY 2015. “Let’s Get It On” hit the top spot in SEPTEMBER 1973.

John Shomby’s Consultant Tips Column Explains How To Get Station Staff (And Listeners) To Buy In On The Brand
“When you ask your listeners what the radio station means to them, what do you get back,” asks COUNTRY’S RADIO COACH owner JOHN SHOMBY in his latest CONSULTANT TIPS column for ALL ACCESS. “Is it equal to what you consider the station’s brand? Have you even asked that question?”
SHOMBY explains the distinction between branding and positioning, and notes that, “Your music is PART of your brand, but it is NOT your brand. Those slogans are part of your brand, but not the essence of it. We are talking about the station’s clear personality and, as we are seeing in just about every national radio research project, the talent and the emotion evoked by the station have become increasingly important to its success.”
He then offers some useful pointers for pinpointing both, along with ideas for getting the station’s whole staff — not to mention its listeners — to buy in on the brand. Learn how in his new column, “Branding And Positioning: Is There A Difference?” Read it here.

RECORDS/COLUMBIA NASHVILLE singer-songwriter ERIN KINSEY has signed with NASHVILLE-based TRIPLE 8 MANAGEMENT.
The 21-year-old TEXAS native drove to NASHVILLE in a U-HAUL the day after graduating from high school, and after initially posting cover songs, gained traction by sharing her own music on social media during the pandemic. She gained more attention when SIRIUSXM added her "Just Drive" to THE HIGHWAY "On The Horizon." She signed her record deal last fall (NET NEWS 11/29/21), and made her GRAND OLE OPRY debut in APRIL.
“ERIN is our first female Country signing, and she is already one of this year’s biggest breakout new Country artists with over 60 million streams, 215,000 followers on TIKTOK, and 122,000 INSTAGRAM followers,” said TRIPLE 8 owner GEORGE COURI. “At 21, she already knows who she is, and her confidence and vocal power on stage is already as good as we could have hoped for.”
